These Terms and Conditions govern your use of the Trade Builders Buying Group website located at tradebuilders.com.au and your membership with Trade Builders Buying Group Pty Ltd (ABN 11 105 269 029) ("TBBG", "we", "us" or "our"). By accessing this website or applying for membership, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or apply for membership.

1. About TBBG

Trade Builders Buying Group Pty Ltd is an Australian-owned and operated buying group for the construction industry, operating since 2000. We are based at Samford, QLD 4520 and service members throughout South East Queensland, from the Gold Coast to the Sunshine Coast and west to Ipswich and surrounding areas.

2. Use of This Website

You may use this website for lawful purposes only. You agree not to:

• Use the website in any way that violates applicable Australian federal or state laws or regulations.
• Transmit any unsolicited or unauthorised advertising or promotional material (spam).
• Attempt to gain unauthorised access to any part of the website, its servers, or any database connected to it.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website.
• Introduce viruses, trojans, worms, or other material that is malicious or technologically harmful.

We reserve the right to suspend or terminate your access to the website at our sole discretion without notice if we believe you have breached these terms.

3. Membership Terms

Membership with TBBG is subject to the following conditions:

• Membership is open to licensed builders, contractors, and tradespeople operating primarily within South East Queensland.
• An annual membership fee applies. The current fee will be communicated to you by our representatives prior to joining.
• Membership is personal and non-transferable. It may not be assigned to another individual or entity without our prior written consent.
• TBBG reserves the right to refuse or revoke membership at its discretion.
• Membership entitles you to access negotiated supplier pricing and other member benefits as described on this website. TBBG does not guarantee the continued availability of any specific supplier arrangement or pricing.
• Member pricing is provided by participating suppliers and is subject to change without notice. You should confirm current pricing directly with the relevant supplier before committing to any purchase or quotation.
• TBBG is transitioning to digital, phone-based membership cards with live membership status. Digital membership credentials are issued to current financial members and remain the property of TBBG.

4. Membership Enquiry Form

By submitting a membership enquiry form on this website, you consent to TBBG contacting you by phone or email to discuss your membership application. Submission of an enquiry does not constitute acceptance of membership or any obligation on either party.

5. Supplier Arrangements

TBBG negotiates pricing arrangements with suppliers on behalf of its members as a collective. TBBG acts as an intermediary only and is not a party to any transaction between a member and a supplier. Any contract for the supply of goods or services is between the member and the relevant supplier. TBBG accepts no liability for the quality, fitness for purpose, or delivery of goods or services provided by any supplier.

6. Refunds & Cancellations

New member refund period. If you are a new member, you may cancel your membership and request a full refund of your membership fee within 30 days of joining, provided you notify us in writing at info@tradebuilders.com.au. This 30-day refund period applies only to a member's first membership fee payment and does not apply to renewal fees or to any subsequent membership period.

Principal Purchases. From time to time, TBBG may sell physical goods directly to members as the seller of record ("Principal Purchase"), as distinct from purchases made directly from a participating supplier under clause 5 (Supplier Arrangements). Principal Purchases are non-refundable where the request arises from a change of mind or from an error made by the member when placing the order (for example, ordering the wrong item, size, or quantity).

Nothing in this clause limits or excludes any right or remedy you may have under the Australian Consumer Law or other applicable legislation that cannot lawfully be excluded, restricted, or modified, including your rights in respect of goods that are faulty, not fit for purpose, or do not match their description. Where the Australian Consumer Law entitles you to a repair, replacement, or refund, we will honour that entitlement.

Resolving issues first. Before pursuing any other avenue, including a dispute, chargeback, complaint to a third party, or legal action, we ask that you first give us the opportunity to resolve the issue directly. This does not affect your right to pursue a remedy under the Australian Consumer Law at any time.

7. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of Trade Builders Buying Group Pty Ltd or its content suppliers and is protected by Australian copyright law. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written permission.

The Trade Builders Buying Group name, logo, and related marks are trade marks of Trade Builders Buying Group Pty Ltd. Nothing on this website grants any licence to use these marks.

8. Privacy

TBBG is committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal information you provide through this website (including enquiry and contact forms) will be used solely for the purpose for which it was collected — that is, to respond to your enquiry or to administer your membership. We will not sell, rent, or share your personal information with third parties except as required by law or with your consent.

9. Payment Processing & Credit Card Data

Where you make a payment to TBBG through this website (for example, a membership fee or a Principal Purchase under clause 6), your card details are entered directly into a secure payment field provided by our payment gateway provider and are sent directly from your browser to that provider. Your card number and security code never pass through or touch our servers, and we do not store, view, or have access to your full card number, expiry date, or security code at any time.

Our servers receive only a one-time payment token generated by the payment provider, which is used to request authorisation for the specific transaction. This approach is consistent with industry-standard practices for reducing the handling of cardholder data by merchant websites. Billing details you provide as part of a payment (such as your name, email, and address) are transmitted to us and to the payment provider to process the transaction, and are handled in accordance with clause 8 (Privacy).

10. Disclaimer & Limitation of Liability

This website and its content are provided on an "as is" basis. To the maximum extent permitted by law, TBBG makes no warranties, express or implied, regarding the accuracy, completeness, or suitability of any information on this website.

To the maximum extent permitted by the Australian Consumer Law and other applicable legislation, TBBG's liability for any loss or damage arising from your use of this website or your membership is limited to the amount of the annual membership fee you paid in the relevant membership year. In no event will TBBG be liable for indirect, incidental, consequential, or special damages of any kind.

Nothing in these Terms and Conditions excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition that cannot lawfully be excluded or limited under the Competition and Consumer Act 2010 (Cth) or any other applicable legislation.

This website may contain links to third-party websites for your convenience. TBBG does not control those websites and is not responsible for their content, privacy practices, or availability. The inclusion of any link does not imply endorsement by TBBG.

13. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland and, where applicable, the Federal Court of Australia.
